Welcome to UP2D8. Please read these terms of use carefully before using the platform. By registering, logging in or clicking on “I agree”, you declare that you accept these terms and agree to be bound by the provisions contained herein.

1. Who is UP2D8?

2. Applicability
These terms and conditions apply to natural persons (consumers) who register or otherwise use the UP2D8 platform via the website, (mobile) app or other channels. Deviating terms and conditions only apply if agreed in writing.

3. Important definitions

  • Platform / UP2D8: the online service, website and (mobile) apps managed by Rovata BV.
  • User: any natural person who registers on or uses the platform.
  • Organisation: an organisation or company that is present on UP2D8 and which you can follow.
  • Personal data: all information about an identified or identifiable natural person.

4. Acceptance of the terms and conditions
By creating an account or using the platform, you agree to these terms and conditions and all policies referred to herein (e.g. our Privacy Policy). If you do not agree, you may not use the platform.

5. Registration and account

  • You must provide accurate, complete and up-to-date information when registering and keep this information up to date.
  • You are responsible for keeping your login details confidential. You must immediately report any unauthorised use of your account to info@up2d8.eu.
  • Your account is personal; you may not transfer your account to others without the prior written consent of UP2D8.

6. Minimum age
You may only create an account if you are of legal age to consent to the processing of personal data in your country. If you are younger than that age, you may only use an account with the consent of a parent or legal guardian.

7. Use of the platform — rules of conduct
You agree to use the platform in a lawful, fair and correct manner. Among other things, you may not:

  • Post illegal, harmful, threatening, defamatory, discriminatory or obscene material;
  • Participate in activities that facilitate fraud, abuse or harm to others;
  • Carry out attacks on the platform, attempt to circumvent security measures or spread malware;
  • Use someone else’s account without permission.

UP2D8 reserves the right to remove content, suspend or terminate accounts in the event of a breach of these rules.

8. Content you post (user-generated content)

  • You retain ownership of the content you post on the platform, to the extent that you are authorised to do so.
  • You guarantee that you own the rights or have permission to use the content and indemnify UP2D8 against any claims from third parties arising from your content.

9. Privacy and processing of personal data
Our Privacy Policy describes what personal data we collect, why we use it, how long we store it and what rights you have. Important points:

  • Personal data is collected when you register, fill in your profile or interact with organisations on the platform.
  • Your data will not be shared publicly unless you give your explicit consent (e.g. when you decide to follow an organisation and your name or other details are disclosed to that organisation).

10. Availability and maintenance

  • We make reasonable efforts to keep the platform available, but cannot guarantee uninterrupted, error-free operation.
  • UP2D8 may carry out planned and unplanned maintenance.

11. Liability and indemnification

  • UP2D8 is not liable for indirect damage, consequential damage or lost profits resulting from your use of the platform, to the extent permitted by law.
  • The legal rules continue to apply to direct damage caused by intent or gross negligence on the part of UP2D8.
  • You agree to indemnify UP2D8 against any third-party claims arising from your use of the platform or caused by your content.

12. Termination and suspension

  • UP2D8 may suspend or terminate your account in the event of a breach of these terms and conditions or other misuse.
  • You can delete your account yourself via the account settings. After termination, we may delete or anonymise personal data in accordance with our privacy and retention policy.

13. Changes to the terms and conditions

  • We may change these terms and conditions. In the event of substantial or detrimental changes for users, we will pay particular attention to communication (e.g. email or in-app notification) and, where necessary, we will request explicit consent in advance.
  • If you do not agree with a change, you can discontinue use of the platform.

14. Force majeure
UP2D8 is not liable for delays or shortcomings in the provision of the service caused by circumstances beyond our reasonable control, such as natural disasters, power failures, internet disruptions, strikes, cyber attacks or far-reaching decisions by third parties.

15. Applicable law and disputes

  • These terms and conditions are governed by Belgian law.
  • For consumers residing in Belgium, the Belgian courts have jurisdiction, with due regard for mandatory consumer protection.
  • If you are a consumer in another country, your legal rights as provided for in your country remain unaffected.

  • If any provision of these terms and conditions proves to be invalid, the other provisions shall remain in force. We will replace the invalid provision with a valid provision that approximates the commercial intent as closely as possible.
  • The fact that UP2D8 does not exercise a right or remedy does not mean that UP2D8 waives that right.
